At Memory That Lasts, your trust is sacred. This Privacy Policy explains, in plain English, what information we collect, how we use it, who we share it with, and the choices and rights you have. We sell jewelry made to be worn with love and kept forever — and we treat your information with the same care.

Who we are

Memory That Lasts LLC ("Memory That Lasts," "we," "us," or "our") is a Delaware limited liability company (DE File No. 10275645) that operates memorythatlasts.com and sells premium personalized engraved jewelry, including pieces customized with the names, dates, and words that matter most to you.

Information we collect

Depending on how you interact with us, we may collect:

  • Order & contact information — your name, email address, shipping and billing address, phone number (if you provide it), and order details.
  • Personalization information — the names, initials, dates, words, or symbols you enter so we can engrave your piece exactly as you intend.
  • Payment information — payments are processed by Shopify Payments and/or other payment providers offered at checkout. We do not see or store your full card number.
  • Website & device information — IP address, browser and device type, pages and products viewed, cart activity, referring source, and approximate (city-level) location, collected through cookies, pixels, analytics tools, and similar technologies.
  • Marketing information — your email and SMS subscription status, preferences, and engagement with our messages and ads.
  • Reviews & support information — reviews, photos, messages, or survey responses you choose to share.

We do not intentionally request "sensitive personal information" such as Social Security numbers, government IDs, financial account numbers, precise geolocation, health, or similar data, and we do not use any such information to infer characteristics about you. Please do not submit sensitive personal information in engraving text, order notes, reviews, or support messages.

How we use your information

We use your information to:

  • Process, personalize, fulfill, and ship your order, and send order confirmations and shipping updates;
  • Create your engraved piece based on the personalization you provide;
  • Provide customer service and respond to your messages;
  • Prevent fraud, abuse, chargebacks, and security issues;
  • Improve our products, website, checkout, and support;
  • Send marketing emails or text messages when you opt in (you can opt out anytime);
  • Request a review after your purchase, where permitted by law and your preferences;
  • Measure advertising performance and show you relevant ads; and
  • Comply with tax, accounting, legal, and regulatory obligations.

How we share information

We do not sell your personal information for money. We share limited information only with trusted service providers and partners that help us run our business, organized by the category of work they do for us:

  • E-commerce platform & hosting (Shopify) — to host our store and manage checkout, orders, and customer data.
  • Payment processors — to authorize payments and help prevent fraud.
  • Production & fulfillment partner(s) — to produce and ship your item; they may receive the order details, shipping information, and the personalization/engraving content needed to make and deliver your piece.
  • Shipping carriers (such as USPS and UPS) — to deliver your order and provide tracking; they receive the recipient's name and delivery address.
  • Email & SMS marketing platform (Klaviyo) — to manage subscriptions, send messages you've opted into, and measure engagement.
  • Reviews platform (Judge.me) — to request and display product reviews.
  • Advertising & analytics partners (such as Google, Meta/Facebook & Instagram, Pinterest, and TikTok) — to understand site traffic and to measure and deliver advertising through cookies, pixels, and similar technologies.
  • Professional advisors (such as accountants, fraud-prevention providers, or legal counsel) — where needed to run and protect the business.
  • Legal & safety — to comply with the law, enforce our terms, or protect our rights, customers, and the public.

Some of our advertising and analytics activity — for example, using cookies or pixels from Meta, Google, Pinterest, or TikTok — may be considered "sharing" for cross-context behavioral advertising, or "targeted advertising," under certain state privacy laws, even though no money changes hands. Cookies, pixels, and advertising

We use cookies, pixels, and similar technologies to keep the site working, remember your cart and preferences, understand how visitors use our site, measure ad performance, and show relevant ads on platforms such as Google, Meta, Pinterest, and TikTok.

You can control cookies through your browser settings (blocking some cookies may affect how the site works). You can also opt out of personalized advertising through the privacy controls offered by these platforms, for example: Meta (facebook.com/settings?tab=ads), Google (adssettings.google.com), Pinterest (pinterest.com/settings/privacy), and TikTok (tiktok.com/privacy/opt-out).

Opt-out preference signals (Global Privacy Control). If you use a browser or device that sends an opt-out preference signal such as Global Privacy Control (GPC), we will treat it as a valid request to opt out of the "sale"/"sharing" of personal information for that browser or device.

Your privacy choices

We want your choices to be easy to find — not buried in this policy. You can:

  • Opt out of "sale"/"sharing" and targeted advertising by visiting our Your Privacy Choices page (also linked as "Do Not Sell or Share My Personal Information" in our website footer), and by using a browser/device opt-out signal such as GPC.
  • Unsubscribe from marketing emails using the unsubscribe link in any marketing email.
  • Stop marketing texts by replying STOP to any marketing SMS (reply HELP for help).
  • Make a privacy request (access, correct, delete, or get a copy of your data) through our contact form.

We will not discriminate against you for exercising your privacy rights. We may need to verify your identity before completing certain requests, and you may use an authorized agent where the law allows.

U.S. state privacy rights

Depending on your state of residence, and where the applicable law applies to us, you may have the right to: confirm whether we process your personal information and access it; correct inaccuracies; delete it; obtain a portable copy; and opt out of the sale of personal data, "sharing"/targeted advertising, and certain profiling. California (CCPA/CPRA) notice

If you are a California resident and the CCPA/CPRA applies to us, you have the right to know, access, correct, and delete your personal information, to opt out of the sale or sharing of personal information, and to be free from discrimination for exercising these rights. We do not sell personal information for money; however, our use of advertising cookies and pixels may be considered "sharing" under California law. You can opt out via our Your Privacy Choices page and via a recognized opt-out preference signal (such as GPC). Because we do not use or disclose sensitive personal information for purposes that would trigger it, a separate "Limit the Use of My Sensitive Personal Information" link is not required.

EU/UK privacy rights

We currently sell and ship to the United States only. If you visit our site from the European Economic Area, the United Kingdom, or a region with similar laws, you may have rights to access, correct, delete, restrict or object to processing, request portability, and withdraw consent (where processing is based on consent), as well as to lodge a complaint with your data protection authority (in the UK, the ICO).

Our legal bases for processing may include: performance of a contract (to process and fulfill your order), consent (for marketing emails or texts where required), legitimate interests (to improve our site, prevent fraud, and run our business), and legal obligations (such as tax and accounting). Your information may be processed in the United States and other countries where our service providers operate; where required, we rely on appropriate safeguards (such as Standard Contractual Clauses) for international transfers.

Marketing emails and texts

You can unsubscribe from marketing emails at any time using the unsubscribe link in our emails. If you opt into SMS marketing, message frequency varies and message and data rates may apply; you can opt out at any time by replying STOP to a marketing text, and reply HELP for help. Transactional messages — like order confirmations and shipping updates — are not marketing and may still be sent as needed to complete your purchase.

How long we keep your information

We keep personal information only as long as needed for the purposes described in this policy, including:

  • Order records: generally up to 7 years (tax, accounting, legal, and fraud-prevention purposes);
  • Customer service messages: generally up to 3 years;
  • Marketing information: until you unsubscribe or request deletion (we may retain limited information needed to honor your opt-out);
  • Website analytics and advertising data: based on the retention settings of the tools we use.

We may keep certain information longer where required by law, to resolve disputes, prevent fraud, or enforce our agreements.

Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information, including HTTPS encryption in transit and limiting access to those who need it. Our store is hosted on Shopify, and payments are processed through PCI-compliant payment infrastructure. No website, platform, or method of transmission is 100% secure, but we take protecting your information seriously.

Children's privacy

Our products are intended for adults, and our site is not directed to children. We do not knowingly collect personal information from children under 13 (consistent with the Children's Online Privacy Protection Act, "COPPA"). We also do not knowingly sell or share, or use for targeted advertising, the personal information of any consumer under 18; for known minors aged 13–17, we will not do so without consent where required by Delaware, California, and other applicable state laws. If you believe a child under 13 has provided us personal information, please contact us and we will delete it.

Changes to this policy

We may update this Privacy Policy from time to time. When we do, we'll update the "Last updated" date above. If the changes are material, we may provide additional notice, such as a notice on our site or an email to subscribers.
